Terms And Conditions1. General Terms
All drawings may or will include a signature that you may not removeI might record the drawing process and post it on my YouTube. I will also ask permission if I decide to use the art for this purpose.Prices are subject to change based on demandI have the right to reject any order that I do not feel comfortable drawing for any reason. Furthermore, I reserve the right to cancel and refund the commission at any time for any reason.I will not claim the intellectual property of the commissioned artwork, your original characters belong to youI will not disclose your personal information to anyone for any reason2. Payment
Currency accepted is USD and will only be accepted through PayPal.Commission will be paid in full before any work is started on the picture.Do not send me any payment before I have agreed to give you a slot and requested you to send a payment.3. Process and Delivery
A rough sketch will be sent to you that you must approve before any further rendering is done.All details needed for the commission (including desired due dates if needed) should be discussed before and during the sketching phase, as major changes will not be made during the final picture (see point 4 below for more details).If changes are requested on the sketch, another sketch will be sent until you are satisfied with the appearance before any further rendering is done.The rough sketch images will include a watermark and will be smaller than the finished piece.The time it takes to finish your commission varies depending on factors such as personal health, the complexity of the commission piece, and other work.Once the piece is finished, you will receive the full resolution image along with a web-friendly sized image. The web-sized image will include a watermark. Note that there is no physical product.After you have approved a sketch and we agree on the final image, you therefore lose the rights to a full refund (see point 7 below for more info on refunds).4. Revisions
Major changes will not be made to the finished pictures.Minor changes (example: slight color changes) may only be made if absolutely necessary, or if I have made a mistake.5. Copyright/Usage PolicyI, Kimberly Stec (the artist), claim the rights to the produced drawing, not the buyer. Therefore, I am allowed to use the copyrighted artwork to:Promote myself with it everywhere.Display it everywhere to my liking (websites, social media, etc.)Use it in a portfolio.Resell original artwork done by Kimberly Stec (the artist), or of popular existing character fan-art (example: Pikachu, Mickey Mouse, etc.). The buyer will be asked for permission if the artist decides to use the requested artwork to be resold, but it will not be resold if permission from the buyer is not granted.I will never resell original character designs created by the buyer, your characters belong to you.The buyer is allowed to:
Use the commission piece for personal use (ex. upload on all your social media, hang in your house, use as an icon, etc.)Print the artwork and claim the character(s) as their own, but not the artwork itself. (I will never claim any original characters or fan-art of existing characters as my own).Use the artwork to promote themselves. Credit to me for the artwork is preferred and very much appreciated, but not mandatory.Use the artwork in their YouTube channel and in monetized videos, so long as the artwork itself is not the main subject for earnings, and they are not claiming the artwork as their own work.The following are considered instances of copyright infringement:
Reproducing/using the copyrighted work commercially (making money off the artwork in any way).Claiming the artwork as their own.Removing or altering the signature or watermark from the artwork.Altering the artwork without the artist’s consentI reserve the full rights to the image and its use/distribution.6. Customer Satisfaction
I will do everything I can to make sure you are satisfied with the final image.If you have a problem with anything regarding the commissioned piece, please tell me right away so we can find a solution together.I would be willing to discuss special conditions for your artwork as needed (example: if you would like consistent updates, or if you do not want your artwork used in a YouTube video).7. Refund/Cancellation Policy
If for any reason I am unable to start/need to cancel your commission, you will receive a full refundIf you cancel your order any time before approving a sketch, you will get a full refund.If you cancel your order after work on the final image has started, you may be eligible for only a partial refund depending on how much work was done.If you cancel the order after the final image is already finished, you will not receive any refund.If you are getting a refund, do not request a PayPal chargeback. I will transfer the money back to you myself.If you request a PayPal chargeback at any point when you were not allowed to ask for a refund, you will lose all beforementioned rights to the commissioned piece and I will have full right to profit further from it in any way. I will decline the chargeback and supply PayPal with our conversations in which we talked about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.If the buyer breaks any of the points stated above, they will lose all the beforementioned rights to the artwork commissioned by me, Kimberly Stec (the artist), and I will have the right to profit further from the artwork in any way I see fit. If you have a problem with any of these statements, they
may be discussed with me prior to paying for your commission piece.What do you get?
Sketches that must be discussed and accepted before the final image is started.Full resolution file at 300 DPI of the final drawing, and a smaller version for an internet upload. File formats are PNG.Insight and involvement on how the final picture looks, if desired.
